Terms of Service

1. Acceptance

By using BoostLand (the Telegram Mini App and the website at boostland.app), you agree to these Terms. If you do not agree, do not use the service.

2. The service

BoostLand is a Telegram Mini App that lets channel owners create and manage giveaways and contests inside their Telegram channels. Owners may optionally connect their own Instagram Business account to view aggregated engagement analytics for that account. In these Terms, an “Owner” is a channel owner who uses BoostLand (including by connecting their own Instagram Business account); a “Participant” is a person who enters a promotion or links/verifies an Instagram account; and a “Promotion” means any giveaway, contest, sweepstakes, or similar campaign created or operated using BoostLand.

3. Eligibility

You must be at least 18 (or the age of majority in your jurisdiction) and able to form a binding contract.

4. Accounts and connected accounts

You are responsible for your account and for any Instagram Business account you choose to connect. You must have the right to connect that account, and you may disconnect it at any time.

5. Giveaways and contests

Promotions are created and operated by channel owners (each, a “Sponsor”) within Telegram. The Sponsor is solely responsible for its promotion’s rules and for compliance with all applicable laws, including lottery, sweepstakes, gambling, consumer-protection, and tax laws; BoostLand provides neutral tooling and is not the Sponsor. No purchase, payment, or paid action of any kind is required to enter or win, and paying does not improve a participant’s chances of winning. Instagram activity (follows, likes, comments, mentions, or messages) is never required to enter or win, and never improves a participant’s chances. Where a promotion offers any paid entry path, the Sponsor must provide a free alternative method of entry with equal odds. All promotions are void where prohibited or restricted by law, and entry is limited to participants in jurisdictions where the promotion is lawful.

6. Instagram disclaimer

Any promotion you run is in no way sponsored, endorsed or administered by, or associated with, Instagram or Meta. You release Instagram and Meta from any responsibility for your promotions.

7. Acceptable use

Do not use BoostLand to break the law, infringe rights, send spam, abuse the platform, attempt to buy/sell/exchange engagement, or violate the terms of Telegram, Instagram, or Meta.

8. Intellectual property

BoostLand and its content are owned by Media Industry LLC or its licensors. We grant you a limited, non-exclusive, non-transferable license to use the service.

9. Third-party services

BoostLand integrates with Telegram and with the Instagram API provided by Meta. Your use of those services is subject to their own terms.

10. Disclaimers

The service is provided “as is” without warranties of any kind to the extent permitted by law. If you are a consumer, nothing in these Terms excludes or limits any rights or remedies you have under mandatory consumer-protection law that cannot be excluded or limited by agreement; where such rights apply, the disclaimers and limitations in these Terms apply only to the extent permitted.

11. Limitation of liability

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including (where applicable) liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for breach of non-excludable statutory consumer rights. Subject to that, and to the maximum extent permitted by law: (a) Media Industry LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business interruption; and (b) our total aggregate liability for all claims arising out of or relating to the service will not exceed the greater of the amounts you paid us for the service in the 12 months before the claim or USD 100.

12. Indemnification

If you use BoostLand as a business or organization, or to create or operate promotions (a “business user”), you agree to indemnify and hold harmless Media Industry LLC from third-party claims, losses, and reasonable costs arising from your promotions, your breach of these Terms, or your misuse of the service. This indemnity does not apply to consumers acting outside a trade, business, or profession. We will notify you of any claim, let you control its defense with counsel reasonably acceptable to us, and reasonably cooperate; you may not settle a claim that imposes obligations on us without our consent.

13. Termination

We may suspend or terminate access for violations of these Terms.

14. General

Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force. Entire agreement. These Terms, together with our Privacy Policy and any promotion rules, are the entire agreement between you and Media Industry LLC regarding the service. Assignment. You may not assign these Terms without our consent; we may assign them to an affiliate or successor. Force majeure. We are not liable for failure or delay caused by events beyond our reasonable control, including outages of Telegram or the Instagram API. Survival. Sections on intellectual property, disclaimers, limitation of liability, and indemnification survive termination.

15. Governing law and disputes

These Terms are governed by the laws of Georgia, without regard to its conflict-of-laws rules, and the courts of Georgia will have jurisdiction over disputes. If you are a consumer habitually resident in the EEA or the UK, this choice of law does not deprive you of the protection of the mandatory provisions of the law of your country of residence, and you may also bring proceedings in the courts of your home country. Before bringing a claim, please contact us at support@boostland.app so we can try to resolve it informally.

16. Changes

We may update these Terms from time to time. We will post the updated effective date, and for material changes we will give reasonable notice (for example, by in-app notice or email where we have your address) before they take effect. If you continue to use the service after changes take effect, you accept the updated Terms; if you do not agree, stop using the service.
